Who we are

FillKite makes a form builder plugin for WordPress and runs the website fillkite.com. In these terms, “FillKite”, “we” and “us” mean the people who build and sell FillKite, and “you” means the person or organisation using the website or the software.

Accepting these terms

These terms apply when you use this website, download FillKite or buy a FillKite Pro licence. By buying or using a licence, you accept them. If you accept them for a company or a client, you confirm that you are allowed to do so. You must be at least 18, or the age of majority where you live, to buy a licence.

The free plugin

The free FillKite plugin is distributed on WordPress.org under the GNU General Public License, version 2 or later (GPL). You may use it on as many sites as you like, change it and share it under the terms of that licence. It is free and will stay free.

FillKite Pro licences

A Pro licence gives you a licence key, plugin updates and support for the plan you bought, for as long as the licence is active. Each plan covers a number of live sites:

• Personal: 1 site.
• Business: 5 sites.
• Agency: Unlimited sites.
• Lifetime licence: the same site limit as the plan you chose, with updates and support for the life of the product and no renewals.

Local and staging copies of a site do not count towards the limit. You can move a licence from one site to another at any time by deactivating it on the old site. The Pro code is also GPL; the licence key, updates and support are what you pay for, and they may not be shared or resold.

Payments through Freemius

Payments are handled by Freemius, Inc., which acts as the Merchant of Record: it sells the licence to you, takes the payment, charges any sales tax or VAT, and sends your invoice. Your purchase is also covered by the Freemius terms. Prices are shown in US dollars.

Renewals and cancellation

Price lock guarantee: an active licence renews at the price first paid, even if list prices go up later.

Yearly licences renew automatically at the end of each year, and we email you before each renewal. You can cancel automatic renewal at any time from your account or by emailing us; the licence then stays active until the end of the year you paid for. If a licence expires, FillKite Pro keeps working on your sites, but you stop getting updates and support. The price lock ends when a licence lapses: renewing later is charged at the list price of that day.

Refunds

If FillKite Pro is not right for you, you can ask for a full refund within 14 days of a purchase or a renewal. See our refund policy.

Acceptable use

You may not use FillKite or this website to break the law, collect data without the consent the law requires, send spam, spread malware, phish for passwords or payment details, or attack or overload our systems. You may not share, publish or resell licence keys, or get around the licence checks. We may end a licence used this way.

Support and updates

Pro licences include email support for as long as the licence is active. Write to us through the contact form or at hello@fillkite.com; we aim to reply within 2 working days. Free users get help in the WordPress.org support forum. Support covers using FillKite as documented and fixing bugs in FillKite; it does not include custom development, or problems caused by other plugins, themes or hosting, though we will always point you in the right direction.

Intellectual property

The FillKite name, logo and this website’s design, text and images belong to us. The GPL covers the plugin code, not our brand: you may not use the FillKite name or logo in a way that suggests we made or endorse your product. Forms and entries you create with FillKite belong to you.

Disclaimer of warranties

We work hard to make FillKite reliable, but the software and this website are provided “as is” and “as available”, without warranties of any kind, to the extent the law allows. We do not promise that FillKite will be free of errors or work with every theme, plugin or host. Keep regular backups of your site.

Limitation of liability

To the extent the law allows, we are not liable for indirect or consequential losses, such as lost profits, lost data or lost business. Our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law.

Termination

You can stop using FillKite at any time. We may suspend or end a licence if you seriously or repeatedly break these terms, or after a chargeback. If we ever stop selling FillKite Pro, active licences keep working and we will tell you in advance.

Governing law

These terms are governed by the law of the country where FillKite is run, without regard to its conflict-of-law rules. If you buy as a consumer, you also keep the protection of the mandatory consumer law of the country where you live. Before any formal dispute, please write to us: most problems are solved with one email.

Changes to these terms

When we change these terms, we update the date at the top of this page. For important changes, we email licence holders at least 14 days before they apply. Changes never affect a licence period you have already paid for.
